Help with having fireamrs returned

I dont want to go into to much detail but here goes.

A local PD aressted me and took control of several of my firearms. After going to court and settling all the legal matters the judge told me I could have my items returned to me. After playing games with the PD they finally told me it would be months before I got my belongings back. Can anyone help me out here, in anyway. Advice or anything,I think they are just busting my balls becasue they dont know the whole story they just see me as someone they aressted and had guns. The courts cleared the chare up and ruled to return my items

Do you have a court order stating so or did the judge tell you verbally? You could call the court and tell them the issue you are having as well as file a complaint with the AG's office. Of course a lawyer could clear it up right away, but at a price.

my lawayer was decent during the court proceedings. he keeps telling me hell do something about having the items returned but to no avail as of now. yes i have paper signed and stamped from superior court statin what is to be returned. the pd told me it takes months due to a chain of command. I did my time in the army i know all about hurry up and wait , but 3-4 months to look at a single peice of paper is ridiculous.

Ill keep the AG option in mind. Im going to give them some time but like i sad 3-4 months , crazy. Thank you

Sounds like they are yanking your chain, because they can. I would wtill give the AG's office a call and ask how long the police have to return your items.

AG says not sure of how long but he said he would think a couple of days is more than enough if i have a court document stating the items to be returned.

Are they going to call the department or write a letter on your behalf?

Negative. The person I spoke with was very proffessional just said he didnt know the answer or who would no the answer. He did say a few days would be sufficient so in a few days If the PD isnt helpful Ill go back to the AG or whereever to file a complaint. I am sure the person I spoke to at the AG couldve found the answer for me but IDK. :BangHead:


I aslo got ahold of my attorney and he said call back today around 5 hell see if he has any new info ..... :BangHead:

Sound like if it takes more than a week or so(without agood explanation) then your rights are being violated by the police. Lets see.....constitutional rights violation should equal at least one new firearm, after legal fees of course. ACLU might be interested in how long it takes the police as well.

Even if the AG says it should only be a matter of days to return the firearms, they can't/won't do anything to enforce it. The PD's excuse that it takes months due to chain of command is a lame excuse. Since you have the court's paper, I would recommend asking your lawyer to send the PD a letter with the court order attached. If the letter didn't specify a timeframe, maybe you can contact the judge again and ask him to amend it with a timeframe.

Did you get your guns back yet?

The attorney who defended you int eh first place should just go to court and make a motion that the judge order your guns returned and within a specific time frame. If he wants to bust balls, and you already have such an order, he can request the police be held in contempt. For an attorney this is routine and easy to do.

Actually I just got them back today. Some more happened causing it to be delayed after the PD called me. Any yes I have them back, I still need my atty to figure out why the felony shows up on my record though. It shouldnt be there but anyway thanks for the info guys.

What condition are they in?

As for the record, contact an attorney and get it expunged. You can do this without an attorney, but whenever I deal with the court system, I like to have an attorney if at all possible. If you need a referral, PM me.

condition appears to be the same as when they were taken. I am just glad to have them back.
